5. Third-Party Businesses, Activities and Services
Unless a page or transaction expressly states otherwise, Explore Kid is a discovery and information platform. Brevard Kid LLC and Explore Kid generally do not own, operate, supervise, control, employ, manage, or provide the third-party Businesses, venues, activities, Events, Classes, childcare providers, healthcare providers, restaurants, attractions, Deals, services, or other third-party offerings listed through the Service.
A listing on Explore Kid is not an endorsement, certification, guarantee, inspection, approval, or recommendation regarding a third-party provider or offering, including its safety, quality, licensing, suitability, accessibility, availability, or legality. The third-party provider is responsible for its own operations, people, products, services, statements, and applicable requirements.
6. Information Accuracy and Changes
We aim to provide useful discovery information, but third-party information can change. Hours, prices, admission, age requirements, Deals, Kids Eat Free offers, menus, schedules, Event dates or times, availability, accessibility or sensory information, policies, addresses, contact information, and cancellations may be updated or may differ from what appears in the Service.
Verify information that is time-sensitive or important to your plans directly with the Business, venue, organizer, or provider before relying on it or traveling. We do not knowingly publish inaccurate information, but we cannot guarantee that all information remains current or complete.
7. Safety and Parent/Guardian Responsibility
Parents and guardians remain responsible for deciding whether an activity, Business, venue, Event, product, or service is appropriate for their family and for supervising children. Explore Kid cannot evaluate every circumstance, hazard, provider, participant, or individual child's needs.
Age-suitability, accessibility, sensory, and similar information is provided to assist discovery. It is not professional, medical, or individualized advice and may not address your family's circumstances. Contact the provider directly about specific needs and follow its instructions and applicable safety guidance.
8. Events and RSVPs
RSVP functionality is a planning and discovery feature. Unless an Event or provider expressly states otherwise, an RSVP through Explore Kid is not a ticket purchase, guaranteed admission, a reservation with the venue, or a guarantee that the Event will occur.
Event organizers and venues remain responsible for their Events. Events may change, be postponed, or be canceled. Confirm important details with the organizer or venue before traveling.
9. Deals, Kids Eat Free Offers and Promotions
Deals, Kids Eat Free offers, and other promotions are generally provided by the identified third-party Business. Availability, eligibility, and conditions may change, and restrictions may apply. Verify the current terms directly with the Business before relying on an offer.
Where Brevard Kid LLC or Explore Kid is not identified as the offer provider, we do not guarantee that a third-party offer will remain available or be honored.
10. Trips, Favorites and Planning Tools
Trips, Favorites, collaborative planning, and related tools are organizational conveniences. You remain responsible for confirming operating hours, routes, availability, reservations, admission requirements, and other details with the relevant provider.
If collaboration is available, share Trips only with people you intend to collaborate with. You are responsible for the information you choose to include and share through those features.
11. Location, Maps and Directions
Location, distance, maps, and directions are convenience features. Location or distance may be approximate, and maps or directions may be incomplete or change. Third-party map and direction services may have their own terms and policies.
Use appropriate judgment, follow real-world signs, closures, safety instructions, and applicable laws, and do not rely exclusively on the Service for navigation or safety decisions.
12. Advertising and Promoted Content
Explore Kid may display paid advertising or promoted placements. Such placements should be identified appropriately in the Service. Paid placement does not mean Explore Kid guarantees, certifies, or recommends an advertiser's product or service.
Advertisers do not receive individual parent or user information merely because you view or click an advertisement.
13. User Content and Reviews
You retain ownership of original Reviews and other content you create and submit (“User Content”). You may submit User Content only if you have the rights and permissions needed to do so and to grant the license below.
You grant Brevard Kid LLC a non-exclusive, worldwide license to host, store, reproduce, display, format, and otherwise use your User Content as reasonably necessary to operate, moderate, improve, and provide Explore Kid. This includes making content visible as directed by you or as part of the feature through which you submit it, and allowing service providers to perform those functions for us. This license does not transfer ownership of your User Content to us.
Public visibility depends on the feature and your choices. Do not submit private or sensitive information that you do not intend to share through the relevant feature.
14. Content Standards and Moderation
User Content must not contain unlawful content, threats, harassment, hateful or discriminatory abuse, obscene or inappropriate material, impersonation, fraud, spam, submissions you know to be false or misleading, intellectual property or privacy-rights violations, or private personal information you are not authorized to disclose.
Use of Reviews and User Content is also subject to applicable Community Guidelines when those guidelines are made available. We may correct, restrict, or remove content when reasonably necessary for moderation, safety, legal compliance, or enforcement. We do not promise that every report or item of content will be reviewed immediately.
15. Business and Organizer Content
Businesses and organizers may submit or manage listing information, Events, Deals, and other content. They are responsible for the accuracy and legality of what they submit, their rights to submit it, and honoring their own offers and policies subject to applicable law.
We may correct, restrict, remove, or decline content that violates these Terms, applicable policies, or law, or that creates safety or security risks.
16. Acceptable Use / Prohibited Conduct
Use the Service lawfully and do not misuse it. You must not use it to commit fraud, impersonate another person, threaten or harass others, or misuse Reviews or reporting features. You must not attempt unauthorized access, bypass security or access controls, interfere with Service operation, introduce malicious code, or scrape or harvest data automatically without authorization.
You must not use the Service in a way that infringes another person's rights or violates applicable law. Nothing in these Terms prohibits conduct that applicable law expressly permits.
17. Intellectual Property
As between you and Brevard Kid LLC, the Service, including its software, design, branding, logos, original content, and databases or compilations to the extent legally protectable, is owned by or licensed to Brevard Kid LLC and is protected by applicable intellectual property laws. These Terms allow normal personal, non-commercial use of the Service.
Except as applicable law permits or we authorize in writing, you may not copy, scrape, reverse engineer, interfere with, circumvent, or exploit the Service or its protected content. These Terms do not transfer ownership of third-party trademarks, Business content, or your original User Content to us.
18. Third-Party Links and Services
The Service may link to third-party websites, maps and directions, Business websites, external ticketing or reservation services, calendars, or other external services. Those services are operated independently and are subject to their own terms and privacy practices.
To the extent permitted by law, Brevard Kid LLC is not responsible for the independent services or content of third parties. A link or integration does not mean we endorse or control that third party.
19. Privacy
Our Privacy Policy explains how information is handled when you use Explore Kid. It is incorporated into these Terms for privacy-related matters. Please review it before using account or personalized features.
20. Account Suspension and Termination
We may restrict, suspend, or terminate access to an account or feature for a material or repeated violation of these Terms, fraud, abuse, security risks, or unlawful conduct, subject to applicable law. Where appropriate, we may take steps to protect users, the Service, or third parties.
We do not impose an arbitrary account-inactivity rule. Provisions that by their nature should continue after access ends will continue to apply, subject to applicable law.
21. Account Deletion
You may delete your Explore Kid account using the account-deletion functionality made available in the Service. We are not listing a separate public account-deletion address here.
Information handling after account deletion is described in the Privacy Policy.
22. Service Availability and Changes
We may change, improve, suspend, or discontinue all or part of the Service or a feature. We do not promise that the Service will always be available, uninterrupted, or error-free.
23. Disclaimer of Warranties
To the extent permitted by applicable law, the Service is provided “as is” and “as available.” We do not warrant that it will be uninterrupted, error-free, or that information or third-party offerings will remain available, accurate, or suitable for your circumstances.
This section does not disclaim a warranty or consumer right that applicable law does not permit us to disclaim.
24. Limitation of Liability
To the extent permitted by applicable law, Brevard Kid LLC will not be liable for indirect, incidental, special, consequential, or exemplary damages arising out of or related to your use of, or inability to use, the Service. This includes losses resulting from reliance on changing third-party information or the independent conduct or offerings of third parties.
Nothing in these Terms excludes or limits liability or a remedy that applicable law does not permit to be excluded or limited, or waives a consumer right that cannot legally be waived.
25. Indemnification
To the extent permitted by applicable law, you agree to defend and indemnify Brevard Kid LLC against a third-party claim and reasonable related costs to the extent the claim arises from your unlawful conduct, your material violation of these Terms, or User Content you submit, including infringement caused by that User Content. This does not apply to the extent a claim results from our own conduct or where applicable law does not permit this obligation.
26. Governing Law
Florida law governs these Terms, without displacing mandatory consumer protections that may apply to you under other applicable law. This section does not select a particular county or court venue.
27. Resolving Concerns
If you have a concern about Explore Kid or these Terms, please contact us at support@explorekidapp.com. We welcome the opportunity to understand and address your concern.
28. Changes to These Terms
We may update these Terms as the Service changes or for other appropriate reasons. We will update the “Last Updated” date and communicate material changes through the Service or another appropriate method. If applicable law requires your acceptance of a change, we will request it as required. Otherwise, continued use after updated Terms take effect constitutes acceptance only to the extent permitted by applicable law.
29. Severability / Entire Agreement / No Waiver
If a provision of these Terms is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. These Terms and policies expressly incorporated into them, including the Privacy Policy, describe the agreement between you and Brevard Kid LLC regarding the Service and replace prior understandings on that subject.
If we do not enforce a provision in a particular instance, that does not waive our ability to enforce it later. Any waiver must be consistent with applicable law.
